This Privacy Policy describes how Offmkt LLC (“Offmkt,” “we,” “us,” “our”) collects, uses, and shares information about you when you use our platform (“Platform”). By using the Platform, you agree to this Policy.

01Information We Collect

Information You Provide:

• Account information: name, email, phone number, professional title, real estate license number and jurisdiction (where applicable), professional photo
• Professional context: market areas, practice areas, transaction volume, deals per year, LinkedIn URL, brief description of your off-market activity
• Listing information: addresses, descriptions, photos, prices, and other content you submit
• Communications: messages you send through the Platform, support requests, and feedback

Information Collected Automatically:

• Usage data: pages visited, features used, time spent, click patterns
• Device information: IP address, browser type, operating system, device identifiers
• Cookies and similar technologies (see Section 05)

Information from Third Parties:

• Payment information processed by our payment processor (Stripe); we do not store full payment card details
• License verification data from state regulatory authorities, where applicable

02How We Use Your Information

We use your information to:

• Operate and provide the Platform;
• Verify your eligibility and professional credentials;
• Process payments and manage subscriptions;
• Display your professional profile to other Members;
• Facilitate communication between Members;
• Respond to your questions and provide support;
• Send transactional emails (account confirmations, billing notices);
• Send service updates and product announcements (with your option to opt out);
• Detect, prevent, and address fraud, security issues, and policy violations;
• Comply with legal obligations;
• Analyze and improve the Platform.

03How We Share Your Information

We share your information only as described below:

With Other Members. Your professional profile (name, photo, title, jurisdiction, practice areas, license number if you have chosen to display it) is visible to other approved Members. Listings you post are visible to other approved Members.

With Service Providers. We share information with vendors who help us operate the Platform — including hosting, payment processing, email delivery, and analytics. These providers are contractually limited to using your information only on our behalf.

For Legal Reasons. We may disclose information if required by law, subpoena, court order, or governmental request, or to protect the rights, property, or safety of Offmkt, our Members, or others.

In Business Transfers. If Offmkt is involved in a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.

We do NOT sell your personal information.

04Your Choices

• Access and Correction. You can access and update most of your profile information through your account settings.
• Deletion. You may request deletion of your account by contacting us. We will delete your information except where we are required to retain it for legal or legitimate business reasons (e.g., tax records, fraud prevention).
• Marketing. You may opt out of non-essential marketing communications by following the unsubscribe instructions in any such email.
• Privacy Settings. You can control which professional details are displayed publicly in your profile settings.

05Cookies

We use cookies and similar technologies to operate the Platform, remember your preferences, and analyze usage. You can control cookies through your browser settings, but disabling cookies may affect Platform functionality.

06Data Retention

We retain your information as long as your account is active, and for a reasonable period thereafter to comply with legal obligations, resolve disputes, and enforce our agreements. Inactive accounts may be deleted after extended periods of inactivity.

07Security

We use reasonable administrative, technical, and physical safeguards to protect your information. However, no system is completely secure, and we cannot guarantee the security of your information. You are responsible for safeguarding your account credentials.

08International Users

The Platform is operated from the United States. If you access the Platform from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data protection laws than your jurisdiction.

09Children's Privacy

The Platform is not intended for individuals under 18. We do not knowingly collect information from anyone under 18. If you believe a child has provided us with information, please contact us.

10California Residents

California residents have certain rights under the California Consumer Privacy Act, including the right to know what personal information we collect, to request deletion, and to opt out of any “sale” of personal information (we do not sell personal information). 11Changes to This Policy

We may update this Policy from time to time. Material changes will be communicated through the Platform or by email. Your continued use after the effective date of the updated Policy constitutes acceptance.
